MATCP Communicable Disease Waiver & Release of Liability

The Michigan Association of Treatment Court Professionals (MATCP) takes steps to reduce the spread of communicable disease, including, but not limited to, COVID‑19, at all MATCP‑sponsored events (“Event”). Despite these efforts, MATCP cannot guarantee that you will not be exposed to or contract a communicable disease while attending. Because of the nature of the Event’s facilities, services, and activities, attending may increase your risk of exposure.

By choosing to attend the Event, you understand and acknowledge that exposure to a communicable disease may result in quarantine requirements, serious illness, long‑term health complications, disability, or death.

You also understand that the risk of exposure may result from your own actions or from the actions, omissions, or negligence of others, including MATCP, its officers, employees, contractors, agents, representatives, sponsors, other participants, and the owners or lessors of the Event premises (“Releasees”).

Assumption of Risk

You knowingly and voluntarily accept all risks, both known and unknown, related to exposure to a communicable disease, even if those risks arise from the negligence of the Releasees. You accept full responsibility for your participation in the Event and agree not to bring claims against MATCP for matters covered by this waiver.

Waiver & Release

In consideration for being permitted to attend the Event, you, on behalf of yourself and your heirs, assigns, personal representatives, and next of kin, agree to the following:

 

You release, covenant not to sue, discharge, and hold harmless the Releasees from any and all claims, liabilities, penalties, demands, judgments, costs, and expenses (including attorneys’ fees) arising out of or related to:

• your illness, injury, disability, or death; or

• the illness of any person who may contract a communicable disease from you, directly or indirectly.

 

This waiver applies to all claims based on the actions, omissions, or negligence of the Releasees, whether exposure occurs before, during, or after the Event.

 

Acknowledgment

By registering for this MATCP‑sponsored Event, you acknowledge that:

• you have read and understand this waiver;

• you understand that you are giving up substantial legal rights; and

• you agree to these terms freely and voluntarily, without inducement.

 

Your registration serves as your electronic signature and acceptance of this Waiver & Release.
